Section 23 of Legislative Decree 81/08 of 09/04/2008 (ex 626/94)

We recommend to our Clients the use of chains or lifting ropes compliant in length and carrying capacity, so that the internal angle forms a minimum 50° / maximum 90° angle. Clients should also confirm that the hooks of the lifting chains or cables have the security tab and this remains intact and readable.

Please remember the necessity of periodic checks on the structure, paying close attention to the connection point of the hook: it should not show any cracks or geometric shapes generated or induced by improper use of lifting geometries.

We is also recommended to intervene on the structure of old-style hooks, see picture on the side, by strengthening them appropriately, so that it is not affected by improper use of lifting geometries (see diagram A).

We remind to our Clients the need to always check their racks and third parties’ racks, which may get back or enter your laboratory: in addition to the EC mark it is necessary to verify the safety of every lifting organ which enters the working environment and value the impact it will have on the employees. The responsibility for an injury caused by a visibly unfit structure also falls on the employer who has allowed the entry.
If the rack is equipped with a EC mark but is clearly lacking in security devices, in case of control, or worse in case of injury, please remember that, by the Italian law, the employer is equally fully responsible.

Do not sell, lend or loan for use any non-compliant rack. According to Italian Laws you are responsible as “Supplier” of the goods and therefore prosecutable in case of accident.

We remind our Clients that a copy of the Manual of Handling and Use should always accompany the rack, especially when it leaves from the glassworks, heading to construction sites or any other companies for further processing.
In fact, every person coming in contact with the rack should have the possibility to be trained about the features, the proper use and the possible risks connected to the improper use this equipment.
From the legal point of view Your company would be protected, as you provided the means to the final user (which may be the operator who unloads the glass from the rack, or the crane driver who will handle that rack on the site, or anyone who handles the rack) to be informed about the possible risks involved with the use of the lifting equipment.

We recommend that the Manual is also mentioned on the delivery note of the glass and rack, to also fulfil the documental obligation. The recipient's signature will witness the receipt of the Manual.
